These Terms of Service govern your use of aitutors.live, a service operated by Indexia Inc. in New York State. By accessing or using the service, you agree to these terms. If you do not agree, do not use the service.
1. Scope of the service
aitutors.live offers AI-powered tutoring tools, including voice and screen-aware study support. The service is intended to help students learn, review, and practice. It is not a marketplace for human tutors unless explicitly stated otherwise within the product.
2. Eligibility and account responsibility
You may use the service only in compliance with applicable law and these terms. You are responsible for maintaining the confidentiality of your login credentials and for activity that occurs under your account. You must provide accurate and current information when using the service.
3. Minors, parents, and schools
If the user is under 18, use of the service should occur with the involvement, consent, or direction of a parent, legal guardian, school, or other authorized adult as applicable. If you use the service on behalf of a student, school, or organization, you represent that you have the authority to do so and to provide any necessary permissions for data shared through the platform.
4. Educational use only
The service is intended for educational support. It is not a substitute for legal, medical, mental health, financial, or other licensed professional advice. You remain responsible for how you use any output, guidance, or suggestions generated by the service.
5. Academic honesty
You may not use aitutors.live to cheat, impersonate a student, complete graded work dishonestly, take tests on someone else's behalf, or violate the rules of a school, teacher, institution, employer, or testing body. The service is designed to support learning, not academic misconduct.
6. Acceptable use and prohibited conduct
You may not misuse the service, interfere with its operation, attempt unauthorized access, upload unlawful or harmful content, reverse engineer the platform except as permitted by law, scrape the service at scale, distribute malware, impersonate others, or use the service in a way that infringes the rights of others.
7. User content and materials you share
You are responsible for content, prompts, files, screenshots, and other materials you submit to the service. You represent that you have the right to submit such materials and that doing so does not violate any law or third-party rights. You retain ownership of your content, but you grant us the limited rights needed to host, process, transmit, and display it in order to operate and improve the service.
8. AI-generated responses
AI-generated responses may be incomplete, inaccurate, outdated, biased, or unsuitable for your situation. You should review outputs critically and use independent judgment before relying on them, especially for important academic, personal, legal, medical, or financial decisions.
9. Fees, minutes, credits, and promotions
Any pricing, free minutes, promotional offers, referral credits, usage allowances, or paid features may be changed, suspended, or discontinued at any time unless otherwise required by law. Promotional credits have no cash value unless explicitly stated.
10. Intellectual property
The service, including its software, design, branding, interfaces, and original content, is owned by Indexia Inc. or its licensors and is protected by intellectual property laws. These terms do not transfer any ownership rights to you except for the limited right to use the service in accordance with these terms.
11. Third-party services and links
The service may rely on or link to third-party services, authentication providers, models, storage tools, or external websites. We are not responsible for the availability, content, or policies of third parties, and your use of those services may be subject to separate terms.
12. Suspension and termination
We may suspend, limit, or terminate access to the service at any time if we believe you violated these terms, created risk for other users or the platform, or if we modify or discontinue part of the service. You may stop using the service at any time.
13. Disclaimer of warranties
The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and uninterrupted operation.
14. Limitation of liability
To the maximum extent permitted by law, Indexia Inc. will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, goodwill, or profits arising out of or related to your use of the service, even if we were advised such damages were possible.
15. Indemnification
You agree to defend, indemnify, and hold harmless Indexia Inc. and its affiliates, officers, directors, employees, and agents from claims, liabilities, damages, losses, and expenses arising from your use of the service, your submitted content, your violation of these terms, or your violation of applicable law or the rights of another person or entity.
16. Changes to these terms
We may update these terms from time to time. Continued use of the service after updated terms are posted means the revised terms apply to your use of the service.
17. Governing law
These terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.
